Why Tracking Matters
Filing and notification deadlines under tax legislation may vary depending on taxpayer type (individual/corporate), the taxation period, and the relevant tax office. Missing a deadline can result in financial sanctions such as late payment interest, tax loss penalties, and irregularity fines. Businesses should therefore map out a general calendar at the start of the year and keep it up to date together with their financial advisor.
Monthly Recurring Obligations
- VAT Return: Filed and paid by the 28th of the following month.
- Withholding and Premium Service Declaration: Filed by the 26th of the following month.
- Stamp Tax Return: Filed within the same period as the VAT return.
- Monthly Premium and Service Document (SGK): Reported jointly within the Withholding and Premium Service Declaration.
Annual and Periodic Returns
- Annual Income Tax Return: Filed by the end of March of the following year.
- Annual Corporate Tax Return: Filed by the end of the fourth month following the close of the fiscal year (end of April for calendar-year taxpayers).
- Provisional Tax Returns: Filed quarterly, by the 17th of the second month following the relevant period.
- Annual Income/Corporate Tax Payment: Generally due on the same date as filing; some taxes have a separate second installment date.
Especially for provisional tax and VAT returns, getting invoices and expense documents to accounting on time during the period is critical for preparing an accurate and timely return.
Penalties for Late Filing
If a return is not filed on time or tax is not paid on time, sanctions such as late payment interest, late payment surcharge, tax loss penalties and irregularity fines may apply under the Tax Procedure Law and the Law on the Collection Procedure of Public Receivables. These penalties can compound depending on the unpaid amount and the length of the delay.
